Who you are buying from

Kymatra is made and supported by Ian Eguiarte. Purchases are handled by Paddle, who act as the merchant of record. That means Paddle is the seller for the transaction, handles payment and tax, and their buyer terms cover the purchase itself. This page covers your licence to use the software.

Your licence

Buying Kymatra gives you a personal, non-exclusive licence to use it. You may:

• Install and use it on any Mac you personally own
• Keep using the version you bought for as long as you like
• Receive updates to Kymatra 1 at no further cost

Please do not:

• Share, publish, resell, or give away your licence
• Redistribute the app itself
• Remove or work around the licence check or the trial period

The licence is not tied to your machine and Kymatra never contacts a server about it. That is a deliberate design choice and it relies on you not passing it around.

You need to be old enough to enter into a contract where you live in order to buy one.

The trial

Kymatra runs free for 14 days with everything unlocked. When the trial ends the visualizer stops drawing and the rest of the app keeps working, so entering a licence starts it again immediately. Nothing is deleted and no data is lost.

Updates

Updates to Kymatra 1 are included, meaning every version numbered 1.x. A future Kymatra 2 may be a paid upgrade. If that happens, the version you bought keeps working, and nothing stops working because a newer one exists.

Kymatra does not check for updates, because it makes no network connections at all. New versions are announced on this site, and you can ask to be told about them by writing to [email protected]. Nothing is ever installed without you downloading it yourself.

Refunds

Thirty days, no questions asked, once. Being refunded ends your licence and you agree to stop using Kymatra; a later purchase is final. How to ask, and what happens afterwards, is set out in full on the refund policy.

No warranty

Kymatra is provided as it is, without warranty of any kind. It has been built carefully and tested, but it is not guaranteed to be free of faults or to be suitable for any particular purpose.

Liability

To the extent the law allows, liability for any claim relating to Kymatra is limited to the amount you paid for it.

Nothing here limits liability that cannot legally be limited, and nothing here removes the statutory rights you have as a consumer where you live. Where those rights and this page disagree, your rights win.

Ending the licence

Your licence ends if you breach these terms, and it ends if you are refunded or if you reverse the payment. You can stop using Kymatra at any time by deleting it.

Governing law

These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law rules. Any dispute that cannot be settled by writing to each other first goes to the state or federal courts located in North Carolina. If the law where you live gives you the right to bring a claim closer to home, this does not take it away.

If part of this does not hold

If any part of these terms turns out to be unenforceable, the rest of them still stand, and that part is treated as narrowed to whatever is enforceable rather than struck out entirely.

These terms, the refund policy and the privacy notice are the whole of the agreement between us about the software. Paddle's buyer terms cover the transaction separately, and nothing here overrides them.

Changes

These terms may change for future purchases. The terms in force when you bought your licence are the ones that apply to it, and the date at the top of this page tells you when it last changed.
